Specifically, statistics from the General Department of Customs show that in 2017, cars imported in the form of gifts and gifts were 987 units. In 2018 it was 266 units. In 2019 it was 213 units. 2020 is 488 units. In 2021, 795 units.

From January 1, 2022 to May 22, 2022, there are 166 units. In the past 6 years, in 2016 alone, the number of cars imported in the form of gifts and gifts was very high, up to 1,064 units. Total imported cars in the form of gifts from 2016 to now is 3,979 units, accounting for 0.85% of the total number of imported cars with 9 seats or less.

The General Department of Customs emphasized that these vehicles are fully taxed according to regulations, including import tax, excise tax, and value-added tax.

Accordingly, in 2016, the total tax collected was 2,328 billion VND; 2017 is 298 billion VND; 2018 is 1,053 billion VND; 2019 is 1,874 billion VND; 2020 is 1,765 billion VND; 2021 is 4.132 billion VND. From January 1, 2022 to May 22, 2022 is 1,222 billion VND. Total tax collected in 6 years is 12,644 billion VND.

The General Department of Customs added that, before Decree 116/2017/ND-CP was issued, the import of cars as gifts was not regulated by the conditions specified in Circular 20/2011. /TT-BCT of the Ministry of Industry and Trade adds procedures for importing passenger cars of 9 seats or less.

According to the provisions of Decree 116/2017/ND-CP dated October 17, 2017 and Decree No. 69/2018/ND-CP dated May 15, 2018, cars imported for commercial business must have a license issued by the Ministry of Industry and Trade. . Imported cars in the form of gifts or presents are not regulated by the provisions of Decree 116/2017/ND-CP.

Regarding quality inspection, imported cars must satisfy the quality conditions prescribed by the Ministry of Transport. For used cars, the year of manufacture must not exceed 5 years from the year of manufacture to the date of manufacture. At the time of import, according to which vehicles imported as gifts or gifts must be checked for quality according to regulations of the Ministry of Transport before customs clearance.

Regarding tax policy, the General Department of Customs said that according to the provisions of tax law, for cars imported as gifts, customs declarants must pay all taxes, specifically: Import tax Import tax, excise tax and value added tax before the goods are cleared, for gift cars, extra income tax must be paid at the domestic tax office.
