“Previously, Nguoi Lao Dong Newspaper, Youth Newspaper on May 23 and VnExpress Newspaper on May 24 had information about workers having difficulty completing procedures to support rent, even after completing the month, they did not receive any money. “- the letter stated.

Regarding this, Prime Minister Pham Minh Chinh assigned the Minister of Labor, War Invalids and Social Affairs (LD-Invalids and Social Affairs) to direct the inspection of the above information, to ensure administrative procedures to support employees. House rent according to Decision No. 8/2022/QD-TTg dated March 28 of the Prime Minister is settled quickly, promptly and conveniently.

According to Decision No. 08/2022/QD-TTg, the two beneficiaries who will receive support are employees currently working in the enterprise and employees returning to the labor market, with the rate of VND 500,000/person/month. and 1,000,000 VND/person/month. Support period up to 3 months.

Previously, on May 23, Nguoi Lao Dong Newspaper reported that the Department of Labor, War Invalids and Social Affairs of Ho Chi Minh City had just sent an urgent dispatch requesting the Ministry of Labor, War Invalids and Social Affairs to guide and remove some obstacles during the implementation of Decision No. Decision 08/2022/QD-TTg on housing rental support for employees.

Specifically, related to the concept of “Employer”, Decision 08 stipulates “Employee is an enterprise, cooperative, or business household with business registration that hires, employs according to the agreement”.

This can be understood that only businesses, cooperatives and business households with business registration can offer to support rent for employees.

The rest, with other types such as representative offices; agencies and organizations licensed to establish by competent agencies; law-practicing organizations in Vietnam in accordance with the law; associations, business associations established in accordance with the law… then employees are not eligible for support?

Regarding beneficiaries and conditions, according to Decision 08, employees entitled to rent support must be participating in compulsory social insurance in the month preceding the time the enterprise makes a list of employees requesting support.

However, comparing the regulations, some cases are enjoying social insurance benefits and not having to pay social insurance contributions, including employees who take leave to enjoy maternity benefits, and employees who take sick leave from 14 days work or more per month.

Therefore, it is not clear whether the above 2 groups are not supported or not?

Decision 08 stated that for employees working in enterprises, enterprises can request social insurance to confirm 2 months or 3 months. As for workers returning to the labor market, there is no provision for lump sum confirmation. So in this case, should the enterprise request support on a monthly basis or is it done for many months?

Decision 08 takes effect from March 28, 2022, but employees who have rented accommodation from February 1, 2022 are eligible for support. Will employees be supported for the period before Decision 08 takes effect (February and March 2022)?

In addition, the Department of Labor, War Invalids and Social Affairs of Ho Chi Minh City also proposed the Ministry to stipulate that within 2 working days from the date of receipt of funds from the People’s Committee, enterprises must immediately pay for employees to avoid the situation that enterprises keep The support money is used for other purposes, leading to late payment to employees. At the same time, the Department suggested that the Ministry should provide guidance on handling in case enterprises are slow to pay employees.

According to statistics of the Department of Labor, War Invalids and Social Affairs of Ho Chi Minh City, there are currently nearly 1.2 million workers in the city who need to receive accommodation rent support with a total estimated cost of nearly 2,100 billion VND. In which, more than 987,000 people are working and more than 205,000 people have returned to the labor market.
