Judgment of the court on the reporter’s case against the Chief Inspector of the Department of Information and Communications
The People’s Court of Can Tho City has denied all requests of the reporter of the Ho Chi Minh City Law Newspaper to sue the Chief Inspector of the Department of Information and Communications of Can Tho City.
On the afternoon of May 31, the People’s Court of Can Tho City sentenced Mr. Chau Le Anh Hao, a reporter for Ho Chi Minh City Law Newspaper, to file an administrative lawsuit against Mr. Nguyen Viet Thanh, Chief Inspector of the Department of Information and Communications of Can Tho City.
According to the lawsuit, on July 22, 2021, Mr. Chau Le Anh Hao was issued a decision by the Chief Inspector of the Department of Information and Communications of Can Tho City to impose a fine of 7.5 million VND for the act of “providing and sharing fake information, informing false information, slander, slander, insult the reputation of agencies, organizations, honor and dignity of individuals”.
After the complaint was unsuccessful, Mr. Hao filed a lawsuit asking the People’s Court of Can Tho City to cancel the decision on sanctioning administrative violations of the Chief Inspector of the Department of Information and Communications of Can Tho City.
In court, Mr. Hao maintained the content of the lawsuit. Mr. Hao said that his words used on social networks do not violate the law in the field of information and communication.
And Mr. Nguyen Viet Thanh, Chief Inspector of the Department of Information and Communications of Can Tho City, mentioned the provisions of the law in the field of information and communication to oppose the petitioner’s opinion. Since then, maintaining the opinion on the sanction of administrative violations against Mr. Hao.
The representative of the People’s Procuracy of Can Tho city also asked the jury to dismiss all of Mr. Hao’s lawsuit claim.
The jury found that Mr. Hao’s articles were sarcastic, sarcastic, mocking, raised issues that were not clear and complete, causing distortions and misunderstandings for readers…
However, the panel also found that the news reports that Mr. Hao shared on his personal Facebook were mainly quoting information from articles accompanied by personal comments, so it was not an act of providing and sharing information. fake news, false news…

The trial panel rejected the entire petition of Mr. Chau Le Anh Hao. After the trial, Mr. Hao said he would appeal.
