According to this delegate, the situation of selling 2-price houses with the actual price higher than the declared price in business and real estate transfer is common, causing loss of state budget revenue.

Previously, the Ministry of Finance and the Ministry of Justice had many documents to implement measures to prevent tax loss, guiding the correct declaration of transfer value. This initially has results, improving the efficiency of State management, ensuring revenue.

However, according to delegate Phan Thai Binh, the direction and guidance are still “general”, not completely solving the root of the problem, but on the contrary, there are shortcomings and consequences in the implementation process.

Mr. Binh analyzed, according to regulations, the tax declaration is the transfer price of land use rights recorded according to the price in the contract. In case the contract does not state the price or is lower than the land price prescribed by the State, the taxable price shall be calculated according to the State framework. However, buying and selling real estate is a civil agreement between the buyer and the seller. The main source of tax loss is the dishonest declaration of a part of people when participating in transactions. Meanwhile, the current local land price list is not close to the market, much lower than the actual price. When trading and transferring real estate, people are subject to a higher tax rate, according to the market price, but when the land is recovered, compensation is applied at the state price, leading to equality in this relationship.

This National Assembly member also said that there is currently no clear legal basis to recognize or not recognize the price declared in the notarized contract as the actual transaction price. Therefore, applying measures to prevent tax loss in business, real estate transfer in localities is “not uniform, each place, each person applies a style”.

According to Mr. Binh, from voters’ feedback, Mr. Binh said that some district-level tax authorities showed arbitrary expressions in applying taxable prices. Many places require people to accept a taxable value that is 1.5-2 times higher than the price prescribed by the State to process the application. In case it is lower than the above level, they will be “soaked” or “invited to work many times”, returning the application for the reason that it is not close to the market.

However, Mr. Binh said, the basis of how to close the market is not clear and not transparent. In fact, there are many localities that are slow to process dossiers, and the overdue situation is very large. This seriously affects people’s business and life.

Besides, according to Mr. Binh, there are some tax officials who are still corrupt and accept the negative for favorable settlement.

Regarding the tightening of real estate tax transfers, Mr. Tran Khanh Quang, a real estate expert frankly said: “How do you know how much is the market price, but you have the right to force people to declare it? re-price?”

Therefore, Mr. Quang suggested, in order to be transparent about the transaction, also to be transparent about the market and to help the real estate market develop stably, when real estate A is trading at any price, it should be updated on the map. planning number. According to Mr. Quang, the annual land price list should be built close to the market price and based on that, the relevant tax should be collected according to the adjustment coefficient.
