Chairman of the Hanoi People’s Committee Chu Ngoc Anh has just signed and promulgated a decision on amending and supplementing a number of articles of the Regulation issued together with Decision No. 13/2017 and annulled Decision No. 25/2018 of the City People’s Committee.

According to this decision, the Hanoi People’s Committee amends Article 10 on the order and procedures for registration and issuance of certificates of land use rights, ownership of houses and other land-attached assets (commonly referred to as red books). or pink book) to the organization receiving the transfer of land use rights, purchase of houses and construction works in housing development projects.

With this amendment, the City People’s Committee decided that in housing development projects that have fulfilled their financial obligations to the investor, the Department of Natural Resources and Environment, based on the results of project inspection and appraisal (regulations), defined in Clause 1, Article 15 of Decision No. 12/2017 dated March 31, 2017), housing purchase and sale contract, commercial floor area for consideration and issuance of red book certificates to organizations.

Objects to be considered under this amendment are organizations that buy houses and commercial floor areas in housing development projects – the decision stated.

The processing time for the above contents shall not exceed 30 working days.

In addition, the City People’s Committee also amends Clauses 1 and 2, Article 11 (documentation, order and procedures for registration of changes in land use and land-attached assets for the case of receiving the transfer of assets attached to land). leased land with annual payment) of the above decision.

Accordingly, the organization submits 1 set of documents at the Department of Natural Resources and Environment, including: Application for registration of changes in land and properties attached to land (original); contract on transfer of assets attached to leased land as prescribed (original); Certificates of land use rights; certificate of land use rights, ownership of houses and assets attached to land (original).

In case of transferring assets attached to a part of the leased land plot, in addition to the above documents, the organization must additionally submit a cadastral measurement of the land plot issued by the Hanoi Land Registration Office or a unit with legal status. survey made, appraised by the Department of Natural Resources and Environment (original – if any) or an extract of the newly split land plot according to cadastral measurement results made by the Land Registration Office (the original); job split plot according to the provisions of Article 75 of Decree No. 43/2014 of the Government.

Within 8 working days from the date of receipt of the application, the Department of Natural Resources and Environment is responsible for appraising and submitting it to the City People’s Committee for a decision on land recovery of the transferor and leased land to the transferee. to use the same works built during the remaining land lease term.

After the City People’s Committee decides, the Department of Natural Resources and Environment will carry out the procedures related to the land lease contract.

After the land user has fulfilled the obligations specified in the land lease decision of the City People’s Committee, the Department of Natural Resources and Environment shall sign the certificate and notify the organization using the land; to correct and update land changes in cadastral records and land databases.

About the time to resolve the above content within 10 working days. In case of a request for certification of ownership of property on land, the processing time shall not exceed 15 working days. Department of Natural Resources and Environment awarded certificate to the grantee within 1 working day.

The Hanoi People’s Committee decided to annul this 25/2018 decision on January 15, 2018 of the City People’s Committee.

Regarding the transitional handling, in case the organization has submitted the dossier before the effective date of this decision but has not yet received the settlement result, the provisions of this decision shall apply.
