If the authorities detect an individual under 18 years old entering the discotheque, will that person or the discotheque business unit be fined?
The Government issued Decree No. 54/2019/ND-CP regulating the business of Karaoke services and discotheque services, dated June 19, 2019. Accordingly, Articles 6 and 8 prescribe the responsibilities of the discotheque business unit, including the following contents:
(1) Comply with the labor law with employees in accordance with the law. Provide uniforms and name plates for employees.
(2) Ensure that sound insulation conditions are met and that sound escapes out of the theater or dance hall in accordance with the National Technical Regulation on noise.
(3) Comply with the provisions of Decree No. 105/2017/ND-CP dated September 14, 2017 of the Government on alcohol trading.
(4) Comply with regulations of law on prevention and control of harmful effects of tobacco.
(5) Comply with the provisions of the law on environmental protection; hygiene and food safety; copyright; labor contract; occupational safety; insurance; social evils prevention and control and other relevant laws.
(6) Not allowed to operate from 02 am to 08 am.
(7) Do not provide discotheque services to persons under the age of 18.
(8) In case there is an art performance program, it must comply with the provisions of the law on art performance.
Thus, according to the provisions of law, people under 18 years old are not allowed to provide discotheque services, so they are not allowed to enter and entertain at bars and discos.
In case of violation, Decree 38/2021/ND-CP stipulating the sanctioning of administrative violations in the field of culture and advertising, effective from June 1, 2021, has specific fines. Accordingly, the subject to be fined is the discotheque business unit. The fine is from 10 to 15 million VND.
5. Fine from 10,000,000 VND copper to 15,000,000 VND for one of the following acts:
a) Providing discotheque services to persons under 18 years of age;
b) Business karaoke services outside the period from 8 hours to 24 hours per day;
c) Modifying, erasing or adding to change the contents of the license to be eligible for karaoke and discotheque services.
