Articles 21, 23 of the Law on Citizenship Identification 2014 stipulates that there are 8 cases where CCCD users (both with chip and without chip) must exchange or apply for a new CCCD card with a new chip: (1) When the citizen reaches the age of 25 years. , full 40 years old and full 60 years old; (2) The card is damaged and cannot be used; (3) Change information about family name, middle name, first name; (4) Change of identity; (5) Redefining gender and hometown; (6) There is an error in the information on the CCCD card; (7) Loss of citizen identification card; (8) To regain Vietnamese nationality according to the provisions of the Law on Vietnamese nationality.

Article 5 of Decree 05/1999/ND-CP stipulates that there are 6 cases where the ID card must be changed to a CCCD with a chip: (9) ID card expires 15 years from the date of issue (guided by Section 2, Part II). Circular 04/1999/TT-BCA); (10) Damaged ID card cannot be used; (11) Change of family name, first name, middle name, date of birth; (12) Change of place of permanent residence registration outside the province or centrally run city; (13) Change of identity; (14) Lost ID card.

If falling into one of the above 14 cases, the user of ID card, CCCD may be fined for not complying with the provisions of law on grant, change and re-issue of CCCD card.

In case of violation of regulations on issuance, management and use of people’s identity cards, ID cards or CCCD cards, Clause 1, Article 10 of Decree 144/2021/ND-CP stipulates, a warning or a fine from 300,000 – 500,000 VND if the violator fails to present his/her ID card, ID card, CCCD card or Certificate of identity card number at the request of a competent person for inspection.

Failure to comply with the provisions of the law on granting, changing and re-granting CCCD cards will also be subject to a warning or a fine of between VND 300,000 – 500,000.

This fine level also applies to those who fail to return their ID card/CCCD to the competent authority when they are granted or deprived of their nationality, or their decision for naturalization is revoked in Vietnam; failing to return the ID/CCCD to custody and temporary detention order enforcement agencies, prison sentence enforcement agencies, decision enforcement agencies to send to reformatories, compulsory education institutions, and drug rehabilitation establishments for arrest. tie
