Mr. Tat Thanh Cang: My mistake was because my subordinates cheated

Mr. Tat Thanh Cang asked the appellate court to review the crime and said that his mistake was due to the deceitful subordinates.

On June 6, the High People’s Court in Ho Chi Minh City opened an appeal hearing for Mr Tat Thanh Cang (Former Deputy Secretary of the Ho Chi Minh City Party Committee) and accomplices in the case “Violation of regulations on management and use of state assets, causing loss and waste” occurred at SADECO Company subsidiary of Tan Thuan Industrial Development Company Limited (IPC).

In the procedural part, the chairman informed that defendant Vu Xuan Duc (former Deputy General Director of IPC) was absent because he was being held in custody in another case and would be escorted to the next day’s trial.

Before that, in January 2022, after the People’s Court of Ho Chi Minh City first-instance trial and sentencing, Mr. Tat Thanh Cang and his accomplices appealed and asked the appellate level to review the judgment of the first-instance court declared; consider the crime and ask for a reduction in the punishment.

Citing the reason for the appeal, Mr. Tat Thanh Cang asked the appellate court to consider the crime declared by the People’s Court of Ho Chi Minh City. Mr. Cang said that the crime declared by the first-instance court was not appropriate. At the same time, his violation of the law was due to dishonest and fraudulent subordinates of the City Party Committee’s Office at SADECO, causing the defendant to give incorrect instructions.

Defendant Te Tri Dung (former Chairman of the Board of Directors of SADECO) appealed for a reduction in the punishment. “The defendant tried to overcome the consequences during the prosecution and investigation stages. After the first-instance court hearing, the defendant’s family compensated the amount that the defendant had to jointly compensate for Sadeco 465 million dong. I hope the appellate panel will consider the case holistically, objectively and comprehensively in order to adjudicate the defendant, in accordance with objective evidences.”

Defendant Ho Thi Thanh Phuc (former General Director of SADECO) and other defendants also maintained their appeal, hoping that the appellate level would reconsider the crime and reduce the sentence.

Defendant Te Tri Dung was identified as the mastermind, took advantage of his position and power to commit a number of crimes, causing a loss of 1,103 billion VND to Sadeco. In which, the loss of state assets is more than 669 billion VND, including the capital of the People’s Committee of Ho Chi Minh City more than 485 billion VND, equivalent to 44%; capital of Ho Chi Minh City Party Committee is more than 184 billion VND, equivalent to 16.7%.

Specifically, in the issuance of shares to strategic shareholders, individuals holding positions at SADECO, IPC and their representatives have already carried out the procedures through the issuance of 9 million SADECO shares to Nguyen Xuan Phuc. Kim without passing the auction or bidding. This is against the rules.

In addition, Te Tri Dung and Ho Thi Thanh Phuc were also determined to have spent SADECO’s money on a number of individuals who were not eligible for foreign tourism but still traveled in the name of “visiting, surveying, studying” contrary to the law. regulations, causing damage to SADECO Company nearly 3.6 billion VND. In which, the loss and damage to the state capital is nearly 2.2 billion dong.

For the act of “Embezzlement of property”, the defendants were handled for violations in using the money from the remuneration and bonus fund of the non-specialist representative in the years 2016, 2017 and 2018.
