It is not recommended to issue a “pink book” for 50-year apartments so as not to cause “fluctuations” in the real estate market

Contradictions on the proposal of a 50-year ownership apartment

The proposal to issue a pink book for apartments with a term of 50-70 years for apartments is a story that has received a lot of attention in recent days.

There are mixed opinions on this matter. As Mr. NTS (Nam Tu Liem, Hanoi) supports this proposal because he thinks that an apartment building, like it or not, still has a lifespan. When making reasonable policies that will be convenient for the future, agree on how to handle it to ensure the common interests of all apartment residents. “Not later because some individuals do not know what will make it difficult to renovate to ensure the safety of residents”, Mr. S. said.

In the same opinion, Mr. LTS (Thanh Xuan, Hanoi) believes that the apartment should have a term. However, it is necessary to have a clear policy mechanism after the expiration of the time limit such as priority for resettlement, priority for buyers who are residents there, purchase price…

Another stream of opinions disagreed with this proposal because they said: “Spending 3 billion VND to buy an apartment with an area of 85m2 with a term of 50 years, it is no different from renting”.

Mr. Su Ngoc Khuong, Senior Director of Investment Department of Savills Vietnam said: “Real estate is always understood as an asset with added value in the future. If this proposal is applied, in the future it is likely to lead to the tendency that people will not choose apartments but switch to buying townhouses or units outside to ensure the long-term value of the property. Therefore, this will cause the liquidity of the apartment market to be affected and the selling price of apartments will slow down.”

The apartment age should not be applied

In this regard, the Ho Chi Minh City Real Estate Association (HoREA) recommends that, at the present time, it is not advisable to stipulate “owning an apartment for a period of 50 years (50 years, 70 years)” to suit the needs and desires of the people.

According to HoREA, people want to “own apartments and condominiums coupled with stable and long-term land use rights”, which are high-value assets left to their children and grandchildren, so as not to cause “fluctuations”. in the real estate market and in society.

The handling of apartment buildings that have reached the end of their “life”, “danger” for occupants shall comply with the policies and mechanisms specified in Decree 69/2021/ND-CP of the Government “on renovation and construction” apartment building” (feasible).

Mr. Le Hoang Chau – Chairman of HoREA said that, in fact, the Housing Law 2014 stipulates 02 housing ownership regimes which are home ownership regimes for an indefinite term (including ownership of apartments, condominiums, etc.). ) associated with “long-term stable” land use rights; or the regime of owning a house with a definite term (including owning an apartment building) attached to a “definite-term” land use right. But the 2014 Housing Law does not stipulate that “owning an apartment building for a limited time” is compulsory.

According to Mr. Chau, the issue of compulsory regulations on “owning a condominium with a term (50 years, 70 years)” applied to new apartment building projects in the near future needs to be further studied. carefully study and evaluate the impact thoroughly and need to consult the people who are the main affected subjects.

However, it is necessary to encourage businesses to implement apartment projects in the form of investing in the current “serviced apartment” project with the apartment ownership term according to the project’s term, universal The variable is 50 years, the selling price is only 70~80% of the price of a permanently owned apartment, so that customers can choose and familiarize themselves with the apartment products with limited ownership.

Just an initial policy proposal

Regarding the above issue, the Ministry of Construction recently affirmed that the proposal to amend the policy on the term of apartment ownership is based on many bases, both in terms of requirements in management and use of shared houses. because it is related to the property and lives of many people. Along with that, it is based on the reality of difficulties and obstacles in the implementation of the current policy of renovation and reconstruction of apartment buildings and with reference to the experience of many countries around the world.

The Ministry of Construction said that this proposal was consulted based on the experience of many countries around the world. For example, China stipulates the ownership term from 50-70 years, Thailand stipulates the ownership term of 30 years and can be extended; Singapore, USA have a maximum ownership period of 99 years and when extended, the owner must pay a certain fee…

When the apartment building’s useful life expires, the ownership period will end (unless it is extended) and the countries will carry out demolition and rebuilding to ensure the safety of users as well as the safety of users. as urban embellishment.

The Ministry of Construction affirmed that the investment in construction of apartment buildings in the coming time is still a major trend in urban areas, especially in large urban areas, which require saving land fund. This is also the general trend of the world and the above proposal will not lead to people switching from buying apartments to buying individual houses, due to the desire to own houses for a long time.

Regulations on the term of apartment ownership will affect the selling price of houses, the selling price will be lower than long-term ownership, thereby creating conditions for people with average financial ability to create Build a home for yourself and your family.

At the same time, it will also meet those who have a need to own a certain term (currently the Law on Housing 2014 also has regulations on buying and selling houses with a definite term, when the time limit for purchase and sale under the agreement has expired). If agreed, the buyer must return the property to the seller).

Proposing specific handling policies will help apartment owners with a limited time still ensure their rights, unlike the concerns that the public is concerned about.

The Ministry of Construction also affirmed that this is only an initial policy proposal (of a policy nature), after being approved by the National Assembly and included in the Law-making Program, the Ministry of Construction will draft specific content to consult widely from experts, scientists and people. The National Assembly will also consider, discuss and evaluate the overall impact of this policy before making a decision.
