The VNA news agency on June 6 reported that the Osaka Prefectural Court – Japan sentenced Alberto to 12 years in prison, lower than the 18-year prison sentence proposed by the prosecutor’s office.

During the trial on June 6, the judge said that at first, defendant Alberto “legitimately defended himself” but attacked international student Trinh Tu Anh (born in 1999, Vietnamese nationality) and pushed him into the Dotonbori River in Vietnam. Osaka City, causing the victim to drown and die in August 2021 even when the victim was unable to resist.

Specifically, Alberto pushed Trinh Tu Anh into the river when the victim was in a state of exhaustion. This is considered an act of violence that goes beyond self-defense and is the main cause of death of Vietnamese students.

On this basis, the Osaka prefectural court sentenced defendant Alberto to 12 years in prison. Earlier, the Osaka prefectural prosecutor’s office proposed an 18-year prison sentence because Alberto attacked Trinh Tu Anh when the victim could not resist and was exhausted.

According to the indictment, on August 2, 2021, Alberto – without a job or permanent residence – repeatedly attacked the head and pushed international student Trinh Tu Anh into the Dotonbori River in Osaka City, causing the victim to die. drowned and died that night. Three days after the incident, the Osaka prefectural police arrested the perpetrator and charged Alberto with murder.

In the trial of the first instance on May 16, 2022, Alberto still insisted on denying the allegation, saying that it was “just acting in self-defense”. The defense lawyer also said that Alberto was not guilty, “the defendant and the victim went out to drink, then the defendant was also beaten by the victim, so he retaliated”.

However, the prosecution agency rejected the above argument, emphasizing: “Although knowing that the victim showed signs of exhaustion, the defendant continued to attack. Even the defendant had acts to stop Trinh Tu Anh. ashore, even though the victim was in danger of losing his life”.

In addition, a witness testified in court that Alberto and Trinh Tu Anh had a fight, “but halfway through, the victim stopped, only the defendant continued to beat”.
