The Government has just issued Decree No. 37/2022/ND-CP amending and supplementing a number of articles of the Decrees providing for penalties for administrative violations in the fields of national defense and cipher; manage and protect national borders; on the seas, islands and continental shelf of the Socialist Republic of Vietnam.

Specifically, a fine of between VND 10-12 million for failure to show up at the right time or place for medical examination and examination stated in the call for medical examination or medical examination for military service of the Commander of the Commanding Committee. district-level military commanders according to the provisions of the Law on Military Service without a valid reason (the old regulations impose a fine of between VND 800,000 and VND 1,200,000).

For acts of intentionally refusing to receive the call for medical examination and medical examination for military service of the commander of the district-level Military Command in accordance with the Law on Military Service without a legitimate reason, he/she will be fined. from 12-15 million VND.

In addition, a fine of between VND 15-20 million will be imposed for one of the following acts: The person receiving the medical examination commits a fraudulent act to falsify his/her health classification results in order to evade military service; giving money, property, or other material benefits worth less than 2,000,000 VND to medical officials, employees or other people in order to falsify the results of the health classification of the examined person or the examined person. military service health to avoid military service (old regulations fined from 2-4 million dong).

Acts of not complying with the order to check, medical examination for military service will be fined from 25-35 million VND.

The Decree also amends and supplements Article 7 which violates regulations on military enlistment. Specifically, a fine of from 30-40 million dong for failure to show up at the right time or at the gathering place stated in the summons to enlist without a valid reason (the old regulations fined from 1.5- 2.5 million dong).

The act of cheating in order to evade the execution of the summons to enlist after having the results of the medical examination for military service and being eligible for military service as prescribed will be fined from VND 40-50 million; a fine of between VND 50-75 million for acts of failing to comply with the order to enlist in the army, except for the two cases specified above.

The Decree takes effect from July 22, 2022.
