According to the newspaper South China Morning Post (SCMP), Hong Kong police on June 8 said they had arrested the 36-year-old woman in the 16-second video above, and searched for the man involved.

The woman was arrested by the Sau Mau Ping Crime Investigation Unit outside a residential building on Muk Tai Street, near Kai Tak Station on June 7, for allegedly engaging in impolite behavior in public and having punishable by imprisonment for up to 7 years.

However, attorney Albert Luk Wai-hung said that it would be more appropriate for her to be charged with “public rudeness”. If found guilty of this, the woman faces up to six months in prison and a $127 fine.

“The balcony is described as a private area, but sex and indecent exposure there will be seen by the public. Their behavior is against the law,” Luk argued.

In addition, those who upload the above video on the internet can also be prosecuted for publishing depraved publications with a maximum penalty of 3 years in prison and a fine of 127,000 USD.

According to police, the video appeared to have been filmed from a building near where the couple had sex, and then spread on the internet.

The woman is currently out on bail but she must report to the police next month. So far, the suspect has not given any statement about the incident. Police said they are continuing to investigate.
