Through inspection and inspection, 19 projects, works and 1 low-rise housing area existed in violation.

Le Van Luong Street extends for about 2km, grows up to 40 high-rise apartments along the route and then, To Huu Street also suffers from the same overload. The wide, beautiful route, but always overloaded with infrastructure, has turned this place into a “hot spot” of the capital during peak hours. The main reason is serious mistakes in adjusting the planning against regulations, loosening construction management.

Inspectors of the Ministry of Construction pointed out that, regarding construction planning, construction planning adjustment, approval and adjustment of the total ground, design plans, formulation, appraisal and approval of projects, violations were violated when only The planning criteria in the later approved project do not match the pre-approved project. Projects with smaller scale are not suitable for projects of larger scale without explaining the difference, without calculating the technical and social infrastructure response.

According to the Inspector of the Ministry of Construction, in the construction planning work on both sides of the road, there are 13 projects that do not conform to the subdivision planning approved since 2015.

In which, the detailed planning adjustment project of 1/500 scale of Ngan Ha Van Phuc residential area (TSQ Galaxy 1), approved by the Hanoi People’s Committee in Decision No. 1807 has the target of high-rise public works. , the kindergarten is not in accordance with the zoning plan approved in 2013 (increase 1-2 floors).

Similarly, the detailed planning of 1/500 scale Him Lam Van Phuc housing area approved by the Hanoi People’s Committee in Decision No. 2245, the lower secondary land plot has 3-12 floors high, not in accordance with the regulations. The approved zoning plan in 2013 is 1-4 floors.

In addition, there are 3 projects, some of which have targets that are not consistent with the detailed planning of 1/5000 scale of Tu Liem district approved in 2000 – the Inspector of the Ministry of Construction cited.

In addition, the updated projects are incorrect, incomplete planning criteria of the projects, total premises, architectural plans that have been approved and approved before. Some planning plots do not have indicators, leading to incomplete data on the current status, not enough basis to study and calculate indicators of technical and social infrastructure for each plot, area and the whole project.

Typically, the planning of subdivision H2-2, updating 6 projects without planning targets. Notably, there are 11 projects that have updated the approved detailed planning wrongly, 21 projects have updated the wrong total ground, and the architectural plan has been approved before. Even the current population data does not specify the source of supply, the year of supply, the population forecast without explanation, not fully calculated according to regulations. Therefore, there is not enough basis to forecast population, calculate indicators of technical and social infrastructure.

The inspection conclusion also pointed out that, in the detailed planning on both sides of Le Van Luong and To Huu streets approved in 2016 only to update and mechanically combine the approved total premises, architectural plans, and population forecasts. The numbers are not explained, not fully calculated, leading to insufficient basis for the study and calculation of technical and social infrastructure. Even the urban zoning master plan H2-2 forecasts that the population in 2050 will decrease compared to 2020 without stating the basis for calculation, reasons for the reduction, and measures to reduce population.

Many projects are not planned and not allowed

The Inspector of the Ministry of Construction cited that in 1998, the Prime Minister approved the adjustment of the general planning of Hanoi capital until 2020 in Decision No. 108. In 2011, the Prime Minister approved the general planning. Hanoi capital in Decision No. 1259.

The detailed planning approved for the first time has basically studied and calculated the responsiveness of technical and social infrastructure. But when redeploying according to the investor’s proposal, many times adjusted the project or adjusted it locally or approved the total ground, architectural plan and then continued to adjust for each project, causing overload. infrastructure and society.

Specifically, the detailed planning on both sides of Le Van Luong street approved in 2016 has a number of planning criteria that are not in accordance with the standards without explanation and calculation such as not ensuring the content of the arrangement of flower gardens and playgrounds in the garden. groups of houses with service radius not greater than 300 m; not arrange medical stations, practice yards, markets, high schools, junior high schools, primary schools; land for education works does not reach 2.7 m2/person. The area of ​​the kindergarten is short of 12,174 m2, the area of ​​public green land for the residential unit is 34,828 m2.

The conclusion clearly shows that the Department of Planning and Architecture has adjusted the planning against the provisions of the law; even “run” according to the investor’s proposal. There are projects adjusted 5 times, many projects change functions from offices, from public to mixed offices, commercial services and apartments for sale, even there are adjusted projects increasing from 5 floors into 30 floors.

This is the main cause of the population growth, the planning criteria do not meet the construction standards of Vietnam for each project, each planning plot, each planning area and urban area, lack of educational land, schools, lack of green areas, service facilities do not guarantee service radius.

The People’s Committee of Hanoi City has adjusted the regulations wrongly when the adjustment is not in the adjusted cases, the adjustment does not calculate the responsiveness of technical and social infrastructure, lacks procedures according to regulations on regulation. Adjustment or adjustment with contents violating Vietnam’s construction regulations in 14/56 inspected projects, projects and works. Among them, 4 detailed planning projects were adjusted, 16 times the detailed planning was adjusted locally, 22 times were adjusted with written approvals.

Not stopping there, illegal and unauthorized projects happen a lot.
