According to the first-instance judgment, Te Tri Dung and members assigned to represent the State’s capital contribution chaired many meetings and signed resolutions approving the transfer of 9 million shares of Sadeco to Nguyen Kim Company with price of 40,000 VND/share – lower than the actual value, causing damage to Sadeco and loss of State assets.

Mr. Cang, in the role of Standing Deputy Secretary of the City Party Committee, understands the regulations that the sale of shares (to increase the charter capital for Sadeco) must be conducted through an auction to select strategic shareholders and appraise the value of the shares. However, the defendant penned “agree” to the policy of issuing shares without skipping these steps, creating favorable conditions for Te Tri Dung and his accomplice to transfer cheaply to Nguyen Kim Investment Joint Stock Company, causing loss of more than 669 billion dong of the State.

In addition, defendant Dung directed his subordinates to spend Sadeco’s money on many individuals traveling abroad in the name of visiting and surveying, causing a loss of more than 2.1 billion VND; embezzled 4.6 billion dong from the company’s remuneration and bonus fund without giving it back to the owners of state capital.

For the above acts, Mr. Cang was sentenced to 10 years in prison for the crime Violation of regulations on management and use of state assets, causing loss and waste. Te Tri Dung received 20 years in prison for the crimes Violation of regulations on management and use of state assets, causing loss and waste and Property embezzlement. The other defendants received between two years of probation and 16 years in prison.

In this appellate sessionthe Procuracy said that the first instance court declared defendant Cang guilty Violation of regulations on management and use of state assets, causing loss and waste is grounded. The representative of the Procuracy noted that Mr. Cang had many mitigating circumstances such as: many achievements in the process of work, his family had revolutionary merits and the consequences of the case had been overcome. five and six months in prison.

The Procuracy also noted that the defendant Dung’s family had additionally compensated Sadeco 485 million dong, which is a new circumstance, so it asked the court to reduce the prison sentence from 6 months to 1 year…

The jury will pronounce the sentence on the afternoon of June 9.
