The old man ‘stiffened his throat’ with the results of the DNA assessment of the fetal tissue in the girl’s belly

On June 9, the Family and Juvenile Court (HCMC People’s Court) opened an appellate trial against defendant Le Duy Hien (74 years old, Binh Trung Tay ward, Thu Duc city, HCMC). on the crime of “having sex with a person from full 13 years old to under 16 years old”, according to the appeal of the defendant and the victim. The victim was only 14 years old at the time of the crime.

Previously, at the first-instance hearing, defendant Hien was arrested by the People’s Court of Ho Chi Minh City. Thu Duc (HCMC) sentenced to 4 years in prison. After the first-instance hearing, Mr. Hien made an appeal, asking for a suspended sentence. The victim thought that the sentence imposed by the first instance court was too light, so there was also an appeal to increase the sentence against the defendant.

According to the first-instance judgment, Ms. Bui Thi B. and her daughter, granddaughter T. (born on April 4, 2006) rented accommodation in Binh Trung Tay ward, District 2, Ho Chi Minh City, near the defendant Hien’s house. Because there is a set of stone tables and chairs in front of Hien’s house, T. and some children in the neighborhood often come here to play.

Around May 2020, the old man lured his grandson T. into his bedroom to have sex.

By the end of June 2020, she discovered that her daughter was showing signs of fatigue and vomiting, so Ms. B took her daughter to the doctor. After an ultrasound, the doctor discovered that baby T. was about 7 weeks pregnant. When asked about her daughter, Ms. B was surprised to learn that the “author” of the fetus was an old man near the motel, so she reported it to the police. However, at the police station, Mr. Hien denied having intercourse with T.
During the investigation, Ms. B. wished to terminate the pregnancy for T. because she was too young and her family was in financial difficulty. If the baby was born, it would affect T.’s future. , the Government has written to request Tu Du Hospital to cooperate in performing forensic medicine to terminate the pregnancy of T.

Based on the DNA forensic conclusion of the Forensic Center (Ho Chi Minh City Department of Health) determined, Mr. Le Duy Hien is the father of the fetal tissue.

With forensic evidence, Mr. Hien admitted to having intercourse with T. once around May 2020.

At the appellate session, neither the defendant nor the victim could present new evidence, so there was not enough ground to accept the victim’s and defendant’s appeal.

After deliberation, the trial panel decided to reject the appeal of the defendant and the victim, upholding the first-instance judgment.
