“In most cases of child sexual abuse and child abuse, the perpetrators are those who have an acquaintance or even close relationship with the victim, who have many opportunities to interact with the victim. contact, approach the victim, take advantage of the opportunity, favorable opportunity to commit the crime.

Subjects who sexually abuse children are partly due to sexual pathologies, the rest are due to deviations in personality, morality, and lifestyle leading to the commission of the offence”, lawyer Binh shared. .

Besides, lawyer Binh also analyzed: “Suppose if the husband’s behavior is true (obscene of his wife’s stepchild), it is necessary to strictly handle it according to the provisions of Article 145 of the 2015 Penal Code. Amended and supplemented in 2017 on the crime of having intercourse and performing other sexual acts with a person from full 13 years old to under 16 years old.

Accordingly, any person who is full 18 years old and has intercourse or performs another sexual act with a person between full 13 years old and under 16 years old, if not falling into the cases specified in Articles 142 and 144 of this Code. This is punishable by imprisonment from 1 to 5 years.

Committing the crime in one of the following circumstances, the offenders shall be sentenced to between 3 and 10 years of imprisonment, such as committing the crime twice or more, of an incestuous nature…”.

“As for the crimes of sexual abuse against children, because of this age, they still have many limitations in awareness and are afraid not to report them. As for the abusers, sometimes they are relatives, living in the same house, making the children afraid.

When there is no evidence, the subjects often deny the crime. Therefore, in this case, it is necessary to collect documents and evidences about the wife’s depraved behavior towards her husband. However, instead of providing evidence for the authorities to deal with according to the law, the husband’s act of “cutting your penis” is an act that is prohibited by law.

This is an illegal act because it infringes on the health and life of others. Therefore, a wife who cuts off her husband’s penis can be punished for intentionally causing injury. If this action damages the husband’s health by more than 11%, the husband has the right to file an application to the police to handle it,” lawyer Binh stated.

According to lawyer Binh, in case the husband does not ask the police for criminal handling, the wife can still be administratively sanctioned by the authorities for the act of “infringing or hiring others to harm the health of the wife.” others” with a fine of 2-3 million VND.

“If the act of cutting the penis causes the husband to lose more than 30% of his health, even if the husband does not request the authorities to handle it, the wife can still be criminally prosecuted for the act of trying to intention to cause injury”, lawyer Binh added.

And if the husband does not ask the authorities for an injury assessment, will he criminally handle the wife cutting off the husband’s penis, lawyer Binh commented: “Regarding this case, the victim If the husband does not ask to go for an injury assessment, the authorities will still ask to go. If the victim does not go, the authorities will take steps as prescribed by law such as coercion … “.

Previously, on the evening of March 20, talking to PV Infonet, Ms. Ha Thi Mai – Chairwoman of the People’s Committee of Chieng Hac commune (Yen Chau district, Son La province) said: “At about 0:00 on March 20, in the area, an incident occurred. the case of the wife using a knife to cut her husband’s penis”.

The victim is NVH (SN 1993, residing in Huoi Sat village, Chieng Hac commune), and the suspect is Ms. HTN (SN 1986).

Talking about the cause of the incident, Ms. Mai informed: “The original cause was believed to be a family conflict. Specifically, the police agency conducts investigation to clarify.”

Also according to Ms. Mai, before coming together, Mr. NVH and Ms. HTN were both married. Ms. N. has a daughter of 14 years old this year, studying in 9th grade. Currently, the two have 2 children together. .

Mr. Lo Duc Tien – Secretary of the Party Committee of Chieng Hac Commune said that the functional forces have now determined the initial cause of the incident.

According to initial information, after many times suspecting that her husband was an NVH who abused her stepdaughter, Ms. HTN talked to her husband but H. did not admit it.

“Due to no evidence, on the afternoon of March 18, Ms. N. went to buy a camera and installed it at her daughter’s bedside to monitor and detect H. had depraved behavior towards her daughter. Too frustrated with her actions. husband, on the night of March 19, N. used a previously purchased knife to amputate Mr. H’s penis. Immediately after performing his act, N. went to the district police headquarters to report,” Mr. Tien said. .

According to Mr. Tien, through initial testimonies, NVH had repeatedly abused his wife’s stepdaughter. Currently, Yen Chau District Police are continuing to investigate and clarify the incident.

The Son La Provincial General Hospital informed that around 5:30 a.m. on the same day, the hospital received and gave first aid to a man nearly 30 years old (residing in Chieng Hac commune, Yen Chau district) in a state of blood pressure shock 90/ 60 because of the amputation of the penis with 2 testicles and is bleeding, has been bandaged.

Immediately after that, the patient had an emergency surgery, diagnosed with a complicated wound, completely severed and no longer a penis and testicle. The patient is now out of danger.
