According to the indictment announced by the representative of the Procuracy, from 2012 to 2015, Khanh Hoa Production and Construction Company Limited (Khanh Hoa Company) was licensed by the Provincial People’s Committee to be the investor of the two projects above.

On July 9, 2012, Mr. Nguyen Chien Thang signed a decision to assign Khanh Hoa Company an area of ​​123 hectares of land to invest in zoning for afforestation combined with eco-tourism.

This company then made a written request to expand the area to 513 hectares. After consulting and signing relevant documents by Mr. Dao Cong Thien, Le Mong Diep, Vo Tan Thai and Tran Van Hung, on June 30, 2014, Mr. Thang signed a decision to increase the area for the project. The authorities determined that Mr. Thang, the head of the Khanh Hoa Provincial People’s Committee, had given many directions throughout, agreed on the policy and signed the decisions to allocate land to enterprises to carry out the project in contravention of regulations. According to the land use planning up to 2020, all land allocated for the implementation of the above project is unused production forest and hilly land.

“The behavior of Mr. Thang and his subordinates and officials of departments and agencies violated the provisions of the Land Law and related documents,” the indictment stated.

For the project Vinh Trung mountain river villa in the area of ​​Chin Khuc mountain, on June 22, 2011, Khanh Hoa Company submitted a written request to change the project’s land use purpose. Mr. Le Duc Vinh, now Vice Chairman of the Provincial People’s Committee, approved the adjustment of the detailed planning to serve the purpose of changing land use purposes for Khanh Hoa Company to implement the project.

According to the VKS, Mr. Le Mong Diep as Director of the Department of Natural Resources and Environment, after verifying the dossier, knew that the change of land use purpose was not in accordance with the law and the land use plan according to the law. planning but still signed a proposal to the Provincial People’s Committee for Khanh Hoa Company to change the purpose of land use for the project.

And Mr. Le Van De, Director of the Department of Construction, reported the appraisal results and asked the Provincial People’s Committee to approve the general construction planning. This is the basis for the Department of Natural Resources and Environment to convert production forest land to non-agricultural land illegally.

After consulting the leaders of the department, on August 15, 2012, Mr. Vinh signed a decision allowing Khanh Hoa Company to change the use purpose of 196,194 m2 from production forest land to residential land and land for other purposes. public to implement the project.

Khanh Hoa Provincial People’s Committee then issued an investment certificate, with the purpose of investing in building technical infrastructure for a new villa area to live in combination with eco-tourism for the investor.

The authorities determined that Mr. Vinh signed the land allocation decisions in violation of the law on land management and land allocation without determining the amount of land use levy or land allocation on the field before the investor fulfilled his obligations. financial services; land allocation or change of land use purpose in violation of land use master plans and plans.

According to the planning project of Nha Trang city to 2020, the land assigned to implement this project is a green and ecological land. In 2019, after reviewing, Khanh Hoa People’s Committee found that the projects at Chin Khuc mountain had been implemented in many stages, lasted for a long time and had many shortcomings in state management, construction and environmental protection. The chairman of Khanh Hoa at this time, Mr. Le Duc Vinh, quickly requested that the project be stopped and the investor had to plant trees and green the “hashed” gaps, but could not restore the original state due to The mountain after being excavated has a steep slope, the soil structure is changed.

After being found guilty, the investor returned 370 hectares of land to regenerate and restore the forest environment. The current status of the project land has been structurally converted into production forest land in accordance with the planning. Authorities did not determine material damage in the case.
