In case the violator does not reside in the district-level area where the police agency has detected the violation, the result of cold fine will be handled as follows:

– Transfer the results to the commune police station where the violator resides: If the violation falls under the sanctioning competence of the commune-level police chief.

– Transfer the results to the district police station where the violator resides: If the violation is not within the sanctioning competence of the commune-level police chief or within the sanctioning competence of the commune-level police chief but the commune-level police have not been informed connected to the network.

Previously, in Circular 65/2020/TT-BCA, after verifying the violator, the police agency where the violation is detected will directly send a notice inviting the violator to the headquarters for settlement.

If the violator does not come to the headquarters of the police agency where the violation is detected to settle, a notice shall be sent to the commune police station where he/she resides.

No need to go back to the place of violation to settle the fine

According to the provisions of Circular 65/2020, when being fined, the violator will receive a notice inviting him to the police headquarters where the violation is detected to handle the violation case. At this time, the person who has been fined is forced to return to the place of violation to deal with it.

However, according to the new regulations, when the violators and vehicles are verified, the results of cold fines will be sent directly to the police headquarters where the violators reside for settlement and handling of violations.

Circular 15 also stipulates that, if it is difficult and impossible to travel directly to the headquarters of the police agency where the violation is detected, the police office of the place where the violation is detected will send a notice requesting request violators to go to the headquarters of the commune-level police station or district-level police station where they reside or are headquartered to settle the case.

When violators come to work, the head of the commune-level police station and the district-level police chief shall make a record and issue a decision to sanction traffic violations according to regulations.

Paying traffic fines at the Public Service Gate of the Ministry of Public Security

Pursuant to current regulations in Article 20 of Decree 118/2021/ND-CP, traffic violators can pay fines through the following forms:

– Deposit cash directly at the State Treasury or the commercial bank where the State Treasury opens an account (indicated in the sanctioning decision).

– Transfer money to the account of the State Treasury through the National Public Service Portal or electronic payment services of banks or intermediary payment service providers.

– Pay fines directly to the traffic police.

– Pay fines via the public postal service.

Notably, with the new regulations in Circular 15/2022, violators will have one more way to pay traffic violation fines, which is to access the Public Service Portal of the Ministry of Public Security.

Extension of time limit for sending automobile registration warning notices

According to Clause 3, Article 19 of Circular 65/2020, within 15 working days from the date of sending the cold fine notice, if the violator does not come to the Traffic Police headquarters, the person with sanctioning competence will send a notice. to the registry to put cars in the warning of vehicles related to administrative violations on the Inspection Management Program.

However, from May 21, 2022, this period will be extended to 20 days but in regular days, not business days.

Thus, if after 20 days from the date the police agency sends the notice of cold fines, but the violator does not come to handle it, the vehicle will be included in the registration warning software of the Vietnam Register.

At this time, if the violation has not been resolved and the car is inspected, the vehicle owner will be refused registration.
