As for the case of Phu Tai Joint Stock Company pouring stone powder to fill the ground holes (left by many illegal miners) not according to the plan in Cat Nhon commune. The inspection results showed that the land areas where the company poured stone powder and crushed stone arising from the Granite Processing Factory in Cat Nhon Industrial Cluster had been approved by the People’s Committee of Binh Dinh Province in Official Dispatch No. 2128/UBND-KT dated April 16, 2021 and the plan to pour stone powder and rubble for ground leveling and environmental restoration requested by the Phu Cat District People’s Committee in Document No. 566/UBND-TNMT dated May 12 2021 and Document No. 2877/SXD-QLXD&VL dated November 30, 2020 of the Department of Construction.

However, in the land area of ​​Lien Tri village, Cat Nhon commune; the western area has an area of ​​1,460m2, Phu Tai Joint Stock Company has poured stone powder and crushed stone but has not poured the arable land layer to plant trees (as the plan has been made), through inspection and required the company has overcome, pour 1 layer of fertile soil, plant trees to restore the environment.

For the western land area with an area of ​​5,541m2, the company is currently implementing the plan of leveling with stone powder and rubble, but there are no signs and barriers. warning “dangerous wormhole” to ensure the safety of people and livestock passing through this area.

For 3 land plots in Chanh Nhon village, Cat Nhon commune, Phu Tai Joint Stock Company is pouring stone powder and rubble for leveling but there are no signs and barriers; After checking the requirements, the company planted barbed wire fences around the land, and hung signs of “dangerous deep holes”.

Exploiting without a decision to lease land

Regarding the case reported by the press, although the license has expired, Tin Thanh Trading and Service Construction Company Limited (in the land mine in Cat Khanh commune) still uses vehicles to exploit the land.

On March 17, the Department of Natural Resources and Environment coordinated with the People’s Committee of Phu Cat District and the People’s Committee of Cat Khanh Commune to inspect the mining and leveling activities of Tin Thanh Company.

This company was granted the License No. 03/GP-UBND by the People’s Committee of Binh Dinh Province on January 22, 2020, allowing the exploitation of soil for leveling materials and block stone as common building materials in Cat Khanh commune, with an area of 1ha exploitation area. The mining term is 2 years from the date of signing (expires on January 22, 2022).

Through actual inspection, the company has not been leased land by the People’s Committee of Binh Dinh province. The mine area has a mining mark within the licensed area, but at the time of inspection, mining activities have been stopped.

According to the company’s presentation, after being granted the mining license No. 03/GP-UBND on January 22, 2020 by the People’s Committee of Binh Dinh province, the company has made a dossier to apply for land lease, but the application for long-term forest conversion.

Meanwhile, the construction schedule of the works of the winning company is in need of leveling land, so the company has exploited it without a decision to lease the land. The company commits to fully implement the land rent (collection) in accordance with regulations and financial obligations on land.

Currently, the company is making an application to extend the time of mineral extraction (land) for the construction of residential projects, rural roads in the area of ​​Cat Khanh, Cat Thanh and Cat Hai communes. The company has won the bid and made a land lease document according to regulations.

The inspection team requested Tin Thanh Company to immediately stop mining activities and assigned the Cat Khanh Commune People’s Committee to be responsible for monitoring and supervising, in case of detecting mineral mining activities without a license from a competent authority. , have not prepared land lease documents, promptly handle (or report to competent authorities for handling) according to regulations.

Violation of Tin Thanh Company, Department of Natural Resources and Environment has established procedures to submit to Binh Dinh Provincial People’s Committee to sanction administrative violations in Official Dispatch No. 989/STNMT-TTRA dated April 22, 2022.

Recently, Phu Cat district has become one of the “hot spots” of this province on the issue of illegal resource exploitation, filling deep holes due to improper land exploitation activities, causing public outrage.

Leaders of Phu Cat District People’s Committee said that in the past time, illegal mineral exploitation in the district has been complicated, especially in areas where there were no roads before, but now the government has opened the way. those who take advantage of the newly opened road to exploit minerals (land, sand) illegally.

In order to rectify, the Phu Cat District People’s Committee affirmed that it will strengthen the leadership and direction of the People’s Committees of communes, towns and related agencies in inspecting and handling illegal mineral exploitation in the area. District.

Strictly handle violations, publicize on means of handling results for violations, especially those reported by the press.

In particular, if the locality continues to exploit illegal minerals in the area, the Chairman of the People’s Committee of the commune or town must be responsible to the Chairman of the District People’s Committee.
