New regulations on cold fines applied from May 21 that people need to know

According to Circular 15/2022/TT-BCA amending Circular 65/2020/TT-BCA that the Ministry of Public Security has just promulgated regulations on powers, obligations, form, content and process of patrolling and controlling , handle administrative violations on road traffic by the Traffic Police (Traffic Police).

In particular, this Circular has many new points to create favorable conditions for people when handling traffic violations that are of great interest to many people, specifically:

Paying traffic fines at the Public Service Gate of the Ministry of Public Security

According to the latest regulations in Circular 15/2022, violators will have one more way to pay traffic fines, which is to access the Public Service Portal of the Ministry of Public Security, to follow the instructions.

Currently, traffic violators can pay fines directly in cash at the State Treasury or the commercial bank where the State Treasury opens an account (indicated in the sanctioning decision); Transfer money to the account of the State Treasury through the National Public Service Portal or electronic payment services of banks or payment intermediary service providers; Pay fines directly to traffic policemen; Pay fines through the public postal service.

Being able to pay fines through the Public Service Portal of the Ministry of Public Security will help violators have more convenient forms of fine payment.

Violators do not need to return to the place of violation to settle fines

With the new regulation, when the violator does not reside in the district-level area where the violation has been detected by the police, the results of the fine will be forwarded to the commune-level police station where the violator resides. if the violation falls under the sanctioning competence of the commune-level police chief) or send it to the district police station where the violator resides.

Currently, according to Circular 65/2020/TT-BCA, after the violator is verified, the police agency where the violation is detected will directly send a notice inviting the violator to the headquarters for settlement.

If the violator does not come to the headquarters of the police agency where the violation is detected to settle, he/she shall send a notice to the commune police station where he/she resides. After that, the violator, upon receiving the sanctioning information, must return to the place of violation for settlement.

Having to go back to the place of violation to solve the cold penalty makes drivers very hard, wasting money, effort and time. Because many violators are in one province but reside in another, they have to go back and forth a few hundred kilometers away to pay fines.

Extension of time limit for sending automobile registration warning notices

From May 21, 2022, when Circular 15/2022/TT-BCA officially takes effect, the time limit for sending notices of automobile registration warnings is also extended to 20 days, but counting on ordinary days, not must work days.

Accordingly, if after 20 days from the date the police agency sends the cold penalty notice, the violator does not come to handle it, the vehicle will be included in the registration warning software of the Vietnam Register. At this time, if the violation has not been resolved and the car is inspected, the vehicle owner will be refused registration.

Currently, according to Circular 65/2020/TT-BCA, within 15 working days from the date of sending the notice of cold fine, if the violator does not come to the traffic police office, the person with sanctioning competence will send a notice to the traffic police station. the registry office to put cars in the warning of vehicles related to administrative violations on the Inspection Management Program.
