Delegate Nguyen Thanh Cong (Ninh Binh delegation), delegate Nguyen Minh Son (Tien Giang delegation) also raised the issue of problems in arranging and handling land of State enterprises with large land areas in many locations. direction. In response to this content, Finance Minister Ho Duc Phuc acknowledged that the arrangement of housing and land, approval of the land use plan was the bottleneck in equitization. Recently, equitization has been slow because of this stage. According to the Minister, when submitting the plan to arrange public assets, houses and land of State enterprises, the Provincial People’s Committee approved the plan, but the implementation was slow. In 2021, only 18 businesses can divest or equitize 4 units, with a total budget revenue of more than VND 4,200 billion.

Specifically, when submitting the plan to arrange public property, the People’s Committees of the provinces were assigned the authority to approve the plan, but this implementation was very slow. The Covid-19 epidemic has greatly affected the situation of financial and securities markets in the country and the region, affecting business valuation, making land use plans to carry out equitization, development and implementation. declare the auction of state capital according to regulations. The calculation of land prices that are not close to market prices creates losses, state assets, and transfers to private properties.

“The solution in the coming time is to change the land use purpose, after equitization enterprises must comply with the planning, ensure the conditions, order and procedures for auctioning land use rights as prescribed. Resolutely recover the land according to the provisions of the law in cases of violations, “said Mr. Phuc.

In addition, according to Decree 32 of the Government, enterprise assets attached to the annual leased land are not included in the enterprise value, but the annual payment of land fee is attached to the enterprise value. “Recently, we have lost a lot through the equitization of state-owned enterprises, mainly from land. This is a loophole that needs to be handled so as not to lose land when switching to equitization,” said Mr. Phuc frankly.

According to the Commander of the Finance sector, for the Decree to define the problem as commercial advantage and put the one-time land rental into the value of the business, through seminars, many experts have judged that it is not reasonable.

Because it is also an assessment of goodwill and according to an estimate, there is no exact criterion to evaluate the value of goodwill. When the value of the business is included, the land price is high today and cheap tomorrow. Therefore, the Minister stated that he will coordinate with the Ministry of Natural Resources and Environment, the Ministry of Planning and Investment and relevant ministries and branches to submit to the Government for amendments.

However, the change of land use purpose, the Minister said, Resolution 60 of 2018 does not allow enterprises of state origin after equitization to change the land use purpose if not used for production and business. business and no longer need, then pay the State. Regarding the issue of attaching the arrangement of real estate to equitization, the Minister of Finance said that real estate is the property of the State.

“In the past, according to Decree 167, now Decree 67, before the transition, an arrangement must be made, which part is kept, which is returned to the State and which part is included in the equitization value or to transferred to equitized enterprises”, the Minister of Information, at the same time, said that “before equitization, arrangements must be made to determine the reasonableness of use”.
