Life sentence for the shooter who shot and killed 2 people in front of a villa in Nghe An

On March 28, the People’s Court of Nghe An province opened a first-instance criminal trial against defendant Cao Trong Phu (SN 1962), residing in Nghi Kim commune, Vinh city, Nghe An province for the crime of “Murder” and “Murder”. Illegally possessing military weapons”.

According to the indictment, before the incident between Phu and the victim, there was a conflict due to debt. In May 2020, D.NA (SN 1956), a native of Vinh City, lives in Ho Chi Minh City thanks to Phu buying a land plot in Nghi Kim commune for 670 million VND (the payment of Phu is not relevant). Because he did not trust anyone, this man wanted Phu to name that land. Phu accepted to help Mr. A. to carry out legal procedures related to the land.

By August 2020, Mr. A. borrowed 500 million VND from Phu. Due to lack of money, Phu mortgaged his land to lend to Mr. A. At Mr. A’s request, Phu transferred VND 500 million to Mr. S., Mr. A’s son-in-law.

Also during this time, Mr. A. promised to sell to Phu the SH car made in Italy for 100 million VND. Believing Mr. A.’s words, Phu transferred to him 100 million dong. However, then Mr. A. gave Phu a domestically produced SH car, but Phu did not take it. After that, Mr. A. did not return the money to Phu.

Due to economic difficulties, after making the cover of land for Mr. A., Phu mortgaged this piece of land to the bank to borrow his own land cover.

Since October 2020, Mr. A. has met Mr. Phu many times to reclaim the land cover. Phu clearly stated that he mortgaged the land cover to get money to give Mr. A. a loan (total of 600 million VND). Phu asked Mr. A. to return the money to Phu to pay the bank and withdraw the land cover to Mr. A. However, Mr. A. did not agree, thereby arising a conflict.

Also during this time, Mr. A. frequently and continuously called and texted Phu to threaten Phu with the content that if he did not return the cover of the land, he would hire someone to kill Phu.

On the morning of April 30, 2021, Phu and his family were making a mausoleum at the cemetery to prepare for his death anniversary. However, he lacked a few ritual items, so Phu went home to get them. Remembering that Mr. A often threatened to kill, Phu carried a K59 gun, which contained 4 bullets, and stored it in a leather bag hanging in front of his stomach for the purpose of self-defense.

Around 7:30 a.m. on the same day, when Phu opened the gate of his house to drive to the cemetery, he saw Mr. A., NQH and N.D.N. They went in a Jeep car to park close to the gate. Mr. A got out of the car, pushed the gate to enter the house, but Phu stopped him from entering. Seeing that, Mr. A. reached inside the gate, grabbed Phu’s collar and threatened to challenge.

Fearing that Mr. A would hire someone to kill him, Phu took a gun and shot Mr. A’s chest.

Hearing the explosion, Mr. H., who was sitting on the driver’s side of the car, got down and approached Phu. Seeing a tall man, wearing camouflage pants and hat walking towards her, Phu was afraid of being beaten. Therefore, Phu raised his gun and shot twice in the head and chest, causing Mr. H. to fall to the ground.

Seeing that, N. ran away. As a result, Mr. A. and Mr. H. died soon after.

In court, Phu confessed that because many times Mr. A. threatened to kill him, the defendant was psychologically inhibited. At that time, without thinking, the defendant took a gun and shot.

In the courtroom, the victim’s family stood up and asked to reduce the punishment for defendant Phu. In this case, the defendant has many mitigating circumstances such as: Committing the crime in the case of threats from the person, the defendant suffering from a paranoid disorder with limited cognitive ability and behavior control ability; sincere declaration, repentance; has influenced the family to compensate for all the consequences and have the legal representative of the victim apply for a reduction of the punishment; The process of living in the locality has many achievements in contributing to the volunteer movement.

The jury sentenced defendant Cao Trong Phu to life in prison for the crime of “Murder”; 3 years in prison for “Illegal possession of military weapons”. The total penalty of defendant Phu must be life in prison.
